The following Terms and Conditions define the rules for using the online store, the way electronic services are provided, and the sales conducted through the online store kreta24.pl, operating at http://www.kreta24.pl/

I. Owner The owner and administrator of the online store is the company: KRETA24 SP. Z O.O., located at 44-100 Gliwice, Dworcowa Street 60, NIP (Tax Identification Number): 6312709208, REGON (National Official Business Register Number): 523804363, KRS (National Court Register Number): 0001005535, phone number: +48 577 799 733. The seller adheres to the Code of Good Practice as defined by the act of August 23, 2007, on counteracting unfair market practices.

II. Definitions Store – the online store located at the internet address http://www.kreta24.pl/. Customer – a natural person, legal person, or organizational unit not being a legal person, to whom the law grants legal capacity, who places an order within the Store. Consumer – a customer, a natural person making a legal transaction with the Seller, not related directly to their business or professional activities. Sale Agreement – a product sales agreement concluded between the Customer and the Seller via the Online Store. Business Days – days from Monday to Friday, excluding statutory holidays. Newsletter – a service provided by the Seller via electronic mail (e-mail), consisting of sending commercial materials to Customers who have previously agreed to this.

III. Rules for using the online store The store's operations include the sale of food products and cosmetics. The store operates 24 hours a day, seven days a week. Information about products posted on the store's website, especially product descriptions, parameters, and prices, do not constitute an offer but an invitation to conclude a contract, as understood by Article 71 of the Civil Code. Technical requirements: To properly and uninterrupted use the store and its services, the Customer's station should meet the minimum technical requirement: an internet connection ensuring data transmission, a web browser for viewing content available on the internet, an active e-mail account, enabled acceptance of cookies and Java Scripts, computer software supporting files of types: .pdf, .doc., .docx, .txt, .jpg, etc.

The store offers its services via the public Internet network. Consequently, using the store's services may be associated with the risk of third-party interference in the transmission of data sent over the internet between the store and the user. Efforts should also be made when using the individual user account: do not entrust your password and login to unauthorized persons and log out of the account if you are not using it at the moment.

To place an order in our online store, there is an option to register in the system, where the user provides their e-mail address: and password: - the account access password. These names are remembered in the system and allow for re-ordering in the system without the need for re-registration. It is also possible to place an order on the store's page without registration and account creation. For this purpose, it is necessary to fill out the order form.

Product prices presented on the site are gross prices (VAT tax is already included in the presented prices) and are expressed in Polish zlotys and EUR when the Buyer sets such a currency. A purchase of goods can be made by a person who has reached 18 years of age and has legal capacity. Kreta24 sp.z o.o. reserves the right to change prices on the website. The Customer ordering goods during the purchase process of goods is asked to fill out the order form in electronic form, in which they provide the following information: first and last name, shipping address (city, postal code, street, apartment number), phone number - to confirm the order, e-mail address, VAT invoice data (if requesting a VAT invoice) The person filling out the order form agrees to the processing of the personal data provided by the seller for advertising purposes and market research. The above data will be stored confidentially. The Customer has access to the data and can modify it. Incorrectly filled order forms will not be considered. The company KRETA24 SPÓŁKA Z O.O. has the right to refuse to execute orders that raise doubts or are filled out incorrectly. Orders can be placed on the page: http://www.kreta24.pl/. Inquiries regarding orders please send to the email address: info@kreta24.pl. The minimum value of an order executed by our online store is 10 PLN. Ordered products are delivered to the address indicated in the order form. Each order is confirmed by the seller within 1 business day in the form of an email sent to the Ordering Party according to the order form. In the case of orders placed for collection upon delivery, orders are confirmed by phone by an employee of KRETA24 SPÓŁKA Z O.O., who establishes the correctness of personal data and the content of the order. In the absence of contact with the Customer, the company Kreta24 sp. z o.o. has the right to cancel the order. In the case of wholesale orders, it is necessary to confirm the financial credibility of the contractor. If a wholesale order is non-standard and the credibility of the Customer has not been confirmed, the company KRETA24 SPÓŁKA Z O.O. may require prepayment for the ordered products. Upon receiving confirmation of the order by the store, a sales agreement is concluded. The seller issues the goods to the Ordering Party no later than within 30 days from the date of conclusion of the contract. A receipt or VAT invoice – at the customer's request, which constitute confirmation of purchase, is always attached to the purchased goods.

IV. Delivery method and time The order is sent to the Ordering Party: - standard parcel via courier company. The price for the shipment is added to the order value according to the price list. Personal collection at the company's headquarters (after prior agreement of the collection date). The delivery time of the shipment is determined by the courier company's regulations for standard parcels, usually within 24 hours from the moment of order execution. InPost parcel lockers – delivery time is determined by InPost regulations (approx. 3 business days). When choosing a shipment via parcel lockers, the Seller is not responsible for the thoughtless selection of goods (e.g., products easily perishable) for the shipping method and prevailing weather conditions (especially in summer and winter). It is also recommended to collect the ordered goods from the parcel locker as soon as possible.

V. Payment methods Payment methods for orders: -automatic or semi-automatic transfer via an authorized payment operator -bank transfer to the account according to the amount on the order form, increased by the cost of shipping. The bank transfer details are provided on the order sheet. The shipment is transferred for execution after the transfer of the payment to the account of KRETA24 SPÓŁKA Z O.O. according to the order form along with the shipping cost. Receipt of the shipment upon delivery by the courier (after agreement). The payment for the shipment and its transport will be collected at the time of its receipt. The shipment is transferred for execution within 48 hours from the moment of placing the order. Cash on delivery orders must be confirmed. For this purpose, it is necessary to provide a contact phone number on the order form. In the case of a stock shortage of the ordered product - it is possible to cancel or modify the order by the buyer. The payment operator is P24 S.A. handling automatic, semi-automatic payments, and payments by Visa, Visa Electron, Maestro, MasterCard, MasterCard Electronic payment cards.

Refund of funds: The seller will make a refund using the same payment methods that the Buyer used.

VI. Delivery costs The Customer bears the costs of shipping the goods ordered by themselves, unless the parties explicitly agree otherwise. The amount of the costs is presented during the execution of the order and depends on the delivery option chosen by the Customer. 

VII. Complaints The Seller is obliged to deliver the purchased goods without defects. If the received goods are damaged or the Ordering Party finds its defectiveness or quality defects - the product will be exchanged or the amount will be returned at the Customer's request. Complaints should be submitted electronically to the address: info@kreta24.pl or additionally by phone at number +48 577 799 733. The complaint should include: the Customer's first and last name, data identifying the transaction (e.g., the identifying transaction number, order placement date, login of the registered user, etc.), the subject of the complaint, circumstances related to its occurrence, photo documentation, contact details: address, email address - enabling contact with the Customer after considering the complaint. The complaint will be considered by the Seller within a maximum of 14 calendar days from the date of receiving the complaint notification. The buyer cannot withdraw from the contract if the defect is insignificant. The Customer may demand repair or replacement with a new good, as well as a price reduction or withdrawal from the contract (if the defect is significant), i.e., a refund. The seller may offer an exchange or repair, but only if it occurs immediately and will not be associated with inconveniences. The seller is liable under the warranty if a physical defect is found before the expiry of two years from the day of handing over the item to the buyer. If the buyer is a Consumer and the subject of the sale is a used movable thing, the Seller is liable under the warranty if a physical defect is found before the expiry of one year from the day of handing over the item to the buyer. In the case of complaints and returns of goods resulting from errors of KRETA24 SPÓŁKA Z O.O., the company refunds the shipping costs and payments for the ordered products. In other cases, the company does not bear financial and legal responsibility for orders made contrary to the customers' expectations - as a result of their errors.

VIII. Withdrawal from the contract According to Art. 27 of the Act on consumer rights (Journal of Laws 2014, item 827), the Customer concluding a "distance contract" - has the right to withdraw from the contract without giving a reason - within 14 calendar days from the date of receiving the product. During this time, the Customer must send the Seller a statement of withdrawal from the contract electronically. You can use the ready-made form (Statement of withdrawal from the contract.doc.). In case of submitting a statement in electronic form, the Seller will immediately send the Customer confirmation of receiving the statement of withdrawal from the contract on a durable medium. After sending the statement, the Customer is obliged within 14 calendar days (counted from the date of sending the statement of withdrawal from the contract) to send the product back to the correspondence address provided by the Seller. In this case, the cost of returning the goods to the Seller is borne by the Customer. The Customer is responsible for the decrease in the value of the item being the subject of the contract, resulting from using it in a way beyond necessary to establish the nature, characteristics, and functioning of the item. The Seller will refund the amount equal to the purchase price increased by the cost of shipping from the Seller to the Customer within 14 calendar days. The Seller may withhold the return of the payment received from the Customer until the item is returned or the Customer provides proof of its return, depending on which event occurs first. If at the time of concluding the contract, the Customer chose a way of delivering the item other than the cheapest usual way offered by the Seller - the Seller is not obliged to return the Customer the additional costs incurred by him exceeding the cheapest way. The Customer, according to Art. 38 of the Consumer Rights Act, does not have the right to withdraw from the contract, in which the price or remuneration depends on fluctuations in the financial market, over which the Seller does not exercise control, and which may occur before the expiry of the withdrawal period, in which the subject of the service is a non-prefabricated item, produced according to the consumer's specifications or serving to satisfy their individualized needs, in which the subject of the service is an item that deteriorates quickly or has a short shelf life, in which the subject of the service is an item delivered in sealed packaging, which cannot be returned after opening the packaging due to health protection or hygiene reasons if the packaging was opened after delivery, in which the subject of the service are items that, due to their nature, become inseparably connected with other items after delivery. The Seller will make a refund using the same payment methods that the Buyer used.

IX. Personal data protection GDPR Based on the provisions of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter: "Regulation"), we inform you that: The Administrator of your personal data is KRETA24 SPÓŁKA Z O.O. with its registered office in Gliwice, Dworcowa Street 60. We use your personal data in the scope of processing orders, their shipment, and accounting and marketing activities. These are the following information: registration data (identification) of the entity, shipping data, accounting data. Your data will be processed for the purpose of Order execution (execution of the Purchase-Sale Agreement) - based on Art. 6 sec. 1 letter b of the GDPR. Recipients of your personal data will only be persons authorized to process data and entities co-participating in the execution of the purchase-sale agreement, including delivering the ordered products to the address indicated by you for delivery. Your personal data may be disclosed to entities cooperating in the processes of delivering orders and in legal–accounting processes based on separate agreements in accordance with the applicable legal regulations. In situations where you provide us with personal data, we assume that in the scope of these data, all obligations required by the GDPR Regulation have been met by you. As the administrator of personal data, we ensure and maintain physical, technical, electronic, procedural, and organizational security measures aimed at protecting personal data against accidental, unauthorized alteration, loss, damage, disclosure, or access by unauthorized persons. Access to your personal data have the following persons: - Properly trained employees of the company KRETA24 SPÓŁKA Z O.O. - Shipping, courier, and transport companies - Accounting and Finance Office. We do not share your personal data with third parties not directly related to the processing and shipping of the order. Your personal data will be stored until the expiration of the limitation period for claims arising from the legal relationship. You have the right to access your personal data, the right to demand their rectification, deletion, or restriction of processing, the right to object to the processing of such data, and the right to their portability. To unsubscribe from the mailing list or make changes in it according to the previous statement, please send the appropriate letter to the email address info@kreta24.pl or to the company's address: KRETA24 SPÓŁKA Z O.O. 44-100 Gliwice, Dworcowa Street 60. Providing your personal data by you is not mandatory, but it is a condition for concluding a purchase-sale agreement. Failure to provide certain personal data results in the impossibility of processing the order, and consequently, the impossibility of concluding a purchase-sale agreement. You have the right to lodge a complaint with the supervisory authority, i.e., the President of the Personal Data Protection Office, if you believe that the processing of personal data concerning you violates the provisions.

X. Final provisions The sale of products by KRETA24 SPÓŁKA Z O.O. takes place according to the principles specified in these Terms and Conditions. Placing an order by the Customer through the website www.kreta24.pl is equivalent to accepting the provisions contained in the Terms and Conditions and obliges the Customer to comply with them. KRETA24 SPÓŁKA Z O.O. reserves the right to change the content of the Terms and Conditions. The change becomes effective from the moment it is posted on the store's website, provided that it does not affect sales agreements concluded before the entry into force of the new Terms and Conditions. In matters not regulated by these terms and conditions, the provisions of the civil code and the act on the protection of certain consumer rights and liability for damage caused by a dangerous product of March 31, 2000, Journal of Laws No. 22, item 271, apply. 4. The website uses cookies to provide services in accordance with the Cookie Policy. You can specify the conditions for storing or accessing cookies in your browser.

XI Sale of alcoholic products only to persons over 18 years of age

The seller has valid permits for the sale of alcoholic beverages, intended for consumption outside the place of sale containing from 4.5% to 18% alcohol no. I/1853/B/102/2024 dated December 21, 2023, issued by the Mayor of Gliwice based on the Act of October 26, 1982, on upbringing in sobriety and counteracting alcoholism (consolidated text, Journal of Laws of 2021, item 1119 t.j./ and Art. 106 § 1 of the Code of Administrative Procedure of June 14, 1960 / Journal of Laws of 2021, item 735 t.j.

The Customer undertakes to collect the ordered Goods at the sales point located in Gliwice at Dworcowa Street 60, on business days between 9.00 – 17.00. The Customer can collect the Goods personally or through another person authorized by the Customer. It is also possible to use the services of a courier company cooperating with the Seller, which will collect the ordered Goods from the Store and deliver them to the place of delivery indicated by the Customer. To use this option, please indicate the relevant information in the purchase form in the field "additional information" with the content: "If my order contains alcohol (wine) I confirm that I am >18 years old and authorize the courier of the DHL or Inpost company (depending on the choice) to collect the parcel on my behalf."
